Missouri Democrat Proposes Bill to Allow Divorce During Pregnancy, Challenging State Law

Missouri State Representative Ashley Aune (D) has introduced a bill aiming to amend existing state law, which currently prohibits finalizing a divorce if a woman is pregnant. Aune’s proposal has ignited discussions around reproductive coercion, domestic violence, and gender equality within marriage dissolution proceedings.

Aune’s motivation for the bill stemmed from her visit to a domestic violence shelter, where she was confronted with the challenges faced by pregnant women seeking divorce. The shelter highlighted cases of reproductive coercion, where individuals, predominantly women, are coerced into remaining pregnant as a means of control within abusive relationships. This manipulation can manifest in various forms, including restricting access to reproductive care and contraceptives, ultimately trapping individuals in unwanted marriages.

In a radio interview on “Up to Date” on KCUR, Aune articulated the need for legislative intervention to address the plight of these women. She emphasized that the current law disproportionately affects victims of domestic violence, compelling them to remain in harmful relationships for fear of losing custody of their children. The shelter even reported the necessity of constructing additional housing to accommodate women fleeing abusive partners with multiple children.

Supporters of Missouri’s existing law argue that it serves to safeguard child custody and child support arrangements. However, Aune countered these arguments by highlighting the detrimental impact of the law on both men and women seeking to dissolve marriages. She stressed that the prohibition on finalizing divorces during pregnancy can perpetuate situations where individuals feel trapped in marriages against their will.

Aune’s proposed legislation challenges the notion that only women are affected by the current restrictions. She underscored scenarios where men may also face coercion, such as instances where a spouse deliberately becomes pregnant to prevent divorce. By acknowledging the complexities of reproductive coercion and its potential impact on both genders, Aune seeks to garner bipartisan support for the bill.

Missouri is not alone in its stringent divorce laws during pregnancy. Similar statutes exist in Texas, Arizona, and Arkansas, where couples are legally barred from finalizing divorces until after childbirth. While couples in Missouri can still initiate divorce proceedings during pregnancy, they must wait until after the birth for the court to address issues of child custody and support.

Aune’s proposal has sparked debate among lawmakers and advocacy groups, with proponents lauding it as a step towards protecting individuals from abusive relationships and ensuring reproductive autonomy.
